Explanation

If the system of “One Nation, One Election” is implemented in India, then it will be necessary to align the tenure of all State Legislative Assemblies with the tenure of the Lok Sabha. In such a situation, the tenure of State Assemblies will have to be increased or reduced accordingly, and the existing tenure of the Lok Sabha will also have to be adjusted in the same manner. Further, after implementing this system, suitable provisions will also have to be made for situations where the Lok Sabha or State Legislative Assemblies are dissolved prematurely. Therefore, for such a system, amendments would be required in Article 83 (Duration of the Houses of Parliament), Article 85 (Sessions of Parliament, prorogation and dissolution), Article 172 (Duration of State Legislatures), Article 174 (Sessions of the State Legislature, prorogation and dissolution), Article 356 (Provisions in case of failure of constitutional machinery in States/President’s Rule in States), etc. It is noteworthy that a high-level committee on “One Nation, One Election” was constituted on 2 September 2023 under the chairmanship of former President Ram Nath Kovind, which submitted its report to President Droupadi Murmu on 14 March 2024.
