In Shayara Bano v. Union of India and Others, a five-judge bench of the Supreme Court, in a landmark judgment in 2017, held the practice of triple talaq (talaq-e-biddat) unconstitutional, declaring it a violation of Article 14 of the Constitution. In support of this judgment, the Parliament of India enacted the Muslim Women (Protection of Rights on Marriage) Act, 2019, making the practice of triple talaq (instant talaq on the basis of pronouncing talaq three times, including in written and electronic form) legally invalid and unlawful.
